Terms and Conditions

Welcome to Flamecraft & Soultrace — a registered sub-brand of Sisuvalo Oy. These Terms and Conditions ("Terms") govern your access to and use of all products, services, and digital offerings provided under this brand by Sisuvalo Oy ("we", "our", "us"). By purchasing, uploading, or interacting with our services, you agree to be bound by these Terms. Please read them carefully and thoroughly.

🌍 Scope of Application

These Terms apply to all physical products (including customized engraved items), digital content ("Eternal Memory" products), commissioned work, and individually crafted artistic services offered to consumers (B2C) and businesses (B2B) internationally.

🗣️ Communication

We primarily communicate in English. However, we also provide customer support in German and Swedish. Please note that the binding language for all legal documents, including these Terms, is English.

🛠️ Products and Services

We offer hand-crafted engraved products, Eternal Memory digital products, and personalized commissioned artworks. Every creation is treated with care, dedication, and our signature Flamecraft soul, whether based on customer uploads or our own artistic resources.

⏳ Pre-Orders and Availability

Items not immediately in stock are marked as "Pre-Order". Delivery times may vary depending on supplier schedules. By ordering a Pre-Order item, you accept potential delays without the right to compensation for late delivery.

🖼️ Uploads, Custom Designs, and Content Standards

Customers uploading designs (via Fancy Product Designer or direct upload) must ensure they have full rights or permissions for the content. All uploads undergo manual review for quality, positioning, and legal compliance. We reserve the right to reject or cancel orders with content that is unlawful, offensive, or violates our standards or EU regulations.

🛡️ Intellectual Property

All original designs, including those created or enhanced using AI, are the exclusive intellectual property of Sisuvalo Oy / Flamecraft & Soultrace. Unauthorized reproduction, commercial use, or modification of our creations is strictly prohibited.

👀 Manual Review and Customer Notification

Each file uploaded by a customer is carefully reviewed manually. If a file is unsuitable for production (e.g., poor resolution, misaligned design, inappropriate content), we will notify the customer via email to arrange corrections before production proceeds.

🚚 Shipping and Delivery

Shipments are made via PostNord, DHL, or UPS. Delivery times vary by region. When sending personal items for engraving, customers must use insured shipping. The risk during shipping rests with the sender unless otherwise agreed in writing.

💳 Payment Methods

We accept payments through Stripe, PayPal, and bank prepayment. Orders are processed only after full payment is confirmed. Payment by invoice is not available.

🔄 Right of Withdrawal and Return Policy

Customers may withdraw from purchases of non-customized products within 14 days of receipt. Personalized or custom-made products (such as engraved or Eternal Memory items) are excluded from the right of withdrawal.

💰 Refunds

Refunds are issued for returned, unused products that comply with our return policy. Return shipping costs are the customer's responsibility unless agreed otherwise.

🛡️ Product Warranty

We warrant that our products are free from material and manufacturing defects upon delivery. Minor differences in color, texture, or structure, inherent in handmade work, are not considered defects.

💾 Use of Digital Products

Eternal Memory digital products are edited and provided through secure cloud download links. Customers are responsible for securely storing their downloads. Redistribution, sharing, or resale is prohibited without express permission.

🧾 Customer Obligations

Customers are responsible for the accuracy of the information provided and for ensuring uploaded materials are lawful, non-infringing, and free from harmful content.

⚖️ Limitation of Liability

Sisuvalo Oy / Flamecraft & Soultrace shall not be liable for indirect damages, consequential loss, loss of data, or financial loss resulting from the use of our products or services. Our liability is limited to the value of the purchased product or service.

🌪️ Force Majeure

We are not liable for delays or non-performance due to circumstances beyond our control, including natural disasters, pandemics, strikes, supply chain disruptions, or government actions.

🔒 Privacy Policy

We process personal data in accordance with our Privacy Policy, adhering to GDPR standards. By using our services, you consent to the handling of your data as described therein.

We also offer social login via Google and Facebook, powered by Nextend Social Login. When using these options, your data (such as name, email, and profile picture) may be transferred to us from the respective platform under your chosen settings. Please consult our Privacy Policy for more details.

📜 Severability Clause

Should any provision of these Terms be invalid, the remaining provisions shall remain in full force and effect.

✍️ Amendments

We reserve the right to amend these Terms at any time. The version in effect at the time of your purchase shall apply.

⚖️ Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Finland. Jurisdiction for any dispute is agreed to be Lapin käräjäoikeus (Lapland District Court), Finland.
